CHAPTER III

  1. Whoever having ceased to be an officer of the Bureau under this Act, who fails to deliver up forthwith the certificate granted to him under section 1 2 and garb, equipment’s and other articles, supplied to him for the execution of his duty, shall be punishable with fine not exceeding one thousand rupees or with imprisonment for a term which may extend to one year, or with both.
  2. Any officer of the Bureau who:

(a)      Shall withdraw himself from the duties of his office in contravention of the provisions of sub-section (1) of section 15;

(b)     Shall engage in any employment or office, in contravention of the provisions of sub-section (2) of section 1 5;

(c)      being absent on leave, shall fail, without reasonable cause, to report himself for duty on the expiry of such leave;

(d)     Shall be gully of any violation of duty or willful breach or neglect of any rule or order made by competent authority;

(e)      Shall be guilty of cowardice; or

(f)      Shall offer Amy unwarrantable personal violence to any person in custody;

Shall be punished with imprisonment for a term which may extend to one year, or with fine not exceeding six months ‘pay, or with both.

  1. (1) Whoever knowingly makes a file statement or uses a false document for the purpose of obtaining for himself or for any other person employment or release from employment as an officer of the Bureau shall be punished with imprisonment for a term which may extend to three years, or with fine not exceeding one thousand rupees, or with both.

(2)     Notwithstanding anything contained in the Penal Code, whoever pretends to hold any office in the Bureau, knowing that he does not hold such office, or falsely personates any other person holding such office, and in such assumed character does or attempts to do any act under color of such office, shall be punished with imprisonment for a term which may extend to three years and shall also be liable to a fine not exceeding one thousand rupees.

(3)     Notwithstanding anything contained in the Penal Code, whoever, not being an officer of the Bureau, wears any garb or carries any token resembling any grab or token used by officers of the Bureau with the intention that it may be believed, or with the knowledge that it is likely to be believed, that he is an officer of the Bureau shall be punished with imprisonment for a term which may extend to one year or with fine which may extend to one thousand rupees, or with both.

(4)     Notwithstanding anything contained in the Burma Official Secrets Act, if the Chairman or any other member of the Board or any officer of the Bureau having in his possession or control any secret official code or password or any sketch, plan, model, article, note, document or information which has been entrusted in confidence to him by any person holding office under the Government or which he has obtained or to which he has or has had access owing to his position as an officer of the Bureau:

(a)      Willfully communicates the code or password, sketch, plan, model, article, note, document or information to any person other than a person to whom he is authorized to communicate it;

(b)     willfully retains the sketch, plan, model, article, note or document in his possession or control when he has not right to retain it, or willfully fails to comply with all directions issued by lawful authority with regard to the return or disposal thereof; or

(c)      willfully fails to take reasonable care of, or so conducts himself as to endanger the secrecy and safety of the sketch, plan, model, article, note, document, secret official code or password of information, he shall be punishable with imprisonment for it term which many extend to three years and shall also be liable to a fine not exceeding one thousand rupees.
